Harb: Assigning acting president needs medical approval of Talabani\

Baghdad (IraqiNews.com) The Legal Expert, Tariq Harb, stated that “Assigning an acting president cannot be done without a medical approval that the President, Jalal Talabani, cannot continue his duties.”

Speaking to Iraqi News (IraqiNews.com), he said “The constitution did not specify the time limit for holding the President Post by acting president.”

“The supervising medical committee did not confirm Talabani’s disability to continue his post, but assured that he is in a medical vacation which means that he is still in his post,” he added, assuring that “The constitution did not allow the president to neglect his tasks even if he is in a medical vacation.”

“The law of the Vice-Presidents No. 1/6 in 2011 states that the Vice-President can be the acting president if the president is in vacation, but he cannot have the same authorities of the president because the latter is still the president,” he concluded.

It is worth mentioning that Talabani’s health condition was disturbed a month ago where he was sent to Germany to complete his treatment after being admitted in the City of Medicine hospital in Baghdad for three days.
